TERMS AND CONDITIONS FOR GROUP CLASSES AT STUDIO SANTE – FITSSEY
§ 1. General provisions
- The organiser of the group classes is Sante sp. z o.o., with its registered office in Warsaw at ul. Jagiellońskiej 55A, 03-301 Warszawa, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 14th Commercial Division, under no. KRS 0000950564, NIP: 5241006610, REGON: 010827252.
- These Terms and Conditions apply to group classes conducted at Studio Sante Uzdrowisko Miejskie. The Terms and Conditions shall be made available to the Participant prior to the conclusion of the contract in a manner enabling the Participant to read their contents at the Studio Sante reception desk and, where the contract is concluded electronically, also to save and reproduce them on the Studio Sante website. The purchase of a service, including a pass or single admission, shall constitute confirmation that the Participant has read the Terms and Conditions.
- These Terms and Conditions shall apply to every Participant in the classes. The purchase of a service, including a pass or single admission, shall constitute acceptance of these Terms and Conditions.
- By purchasing a service, the Participant also undertakes to comply with the regulations applicable at the premises where the classes take place, insofar as they concern the use of those premises, in particular the Rules of the Sauna and Swimming Pool Area, available at studiosante.pl/en/regulations/ and at the Studio Sante reception desk.
- Classes shall take place in accordance with the timetable available on the Studio Sante website and in the Fitssey application.
- Only persons who hold a valid and paid-up pass or have purchased a single admission and have made a booking for the relevant class may participate in the classes.
- A place must be booked in advance before attending a class. Bookings may be made via the website or the Fitssey application.
- Payments for services may be made via Przelewy24, by standard bank transfer or on the premises by card or in cash.
- After purchasing a pass, the Participant may book individual classes for any available date during the validity period of the pass, subject to availability.
- Group classes may be attended by adults and by persons aged 16 or over, provided that they present the written consent of their legal representative to the conclusion of a contract with Studio Sante Uzdrowisko Miejskie, acceptance of these Terms and Conditions and participation in the classes.
§ 2. Bookings and cancellations
- The Participant may cancel a booking without losing an admission from their pass, provided that the cancellation is made no later than 24 hours before the scheduled start of the class (an “early cancellation”).
- If a booking is cancelled less than 24 hours before the scheduled start of the class (a “late cancellation”), or if the Participant fails to attend the class, the admission from the pass shall be deemed to have been used and may not be reinstated or refunded.
- If Studio Sante cancels a class, the admission from the pass used for that class shall not be forfeited. The Participant may use it on another date during the validity period of the pass. If the cancelled class was paid for as a single admission, the Participant may use the paid admission for another class or receive a refund of the amount paid.
§ 3. Organisation of classes
- Participants must arrive for all group classes at least 15 minutes before their scheduled start time.
- Once a class has commenced, the Participant may not join the group. Late arrival may result in refusal of admission to the class for organisational and safety reasons.
- Studio Sante Uzdrowisko Miejskie reserves the right to cancel a class if an insufficient number of Participants have registered (a minimum of six persons) or for reasons beyond Studio Sante’s control.
- If Studio Sante cancels a class, Participants who have made a booking shall, where possible, be informed of the cancellation using the contact details provided when making the booking. If a class is cancelled, the rules set out in § 2 item 13 of these Terms and Conditions shall apply.
§ 4. Safety and rules of participation
- The Participant should adjust the intensity of the exercises performed to their state of health, level of fitness and current wellbeing and should follow the instructor’s directions regarding the correct and safe performance of exercises. The Participant should refrain from performing exercises if, due to their state of health or wellbeing, such exercises could pose a risk to their health or safety. The foregoing shall not exclude or limit the Organiser’s liability under the applicable provisions of law.
- Before the commencement of a class, the Participant shall inform the instructor of any relevant health conditions, injuries or mobility limitations and, insofar as they may be relevant to safe participation in the class, any medication being taken.
- The instructor may refuse to allow the Participant to take part in a class or may discontinue their participation if the instructor considers that such participation may pose a risk to the health or safety of the Participant or any other person.
- In the case of fitness classes, only persons wearing sportswear and clean, indoor sports footwear may enter the exercise room. Participants may exercise barefoot where permitted by the nature of the relevant class.
- During classes involving the use of mats, Participants shall bring their own towel and place it on the mat for hygiene purposes.
- Each Participant shall take care of the equipment they use and use it only for its intended purpose and in accordance with the instructor’s directions.
- In the case of Hot Yoga classes in the Ganbanyoku sauna, the Participant shall bring a change of clothing made from natural, breathable materials, suitable for the conditions in the Ganbanyoku sauna, as well as flip-flops.
- During Hot Yoga classes, Participants shall bring their own towel and place it on the mat for hygiene purposes.
§ 5. Items left at Studio Sante
- Items left on the Studio Sante premises shall be stored for the period prescribed by the applicable provisions of law and the internal rules applicable at the premises.
- Upon expiry of the storage period, if the owner has not come forward, the items shall be transferred to the competent mayor or another authorised entity in accordance with the applicable provisions of law or, where permitted by law, removed or disposed of.
§ 6. Complaints
- The Participant may submit a complaint concerning the services provided, in particular where they have not been performed or have been improperly performed.
- A complaint may be submitted electronically to reklamacje@studiosante.pl, in writing to Sante sp. z o.o., ul. Jagiellońska 55A, 03-301 Warsaw, or in person at the Studio Sante reception desk.
- A complaint should include, in particular, the Participant’s full name, contact details, a description of the matter and the remedy sought by the Participant. The absence of any of the above information shall not automatically result in the complaint being left unconsidered if the subject matter of the complaint and a means of contacting the Participant can be established from its contents.
- Complaints shall be considered within 14 days of their receipt, and the response shall be sent to the email address or correspondence address specified by the Participant.
§ 7. Withdrawal from a distance contract
- A Consumer who has concluded a distance or off-premises contract shall have the right to withdraw from the contract within 14 days without giving any reason, subject to the exceptions provided for under the applicable provisions of law.
- The Consumer shall not have the right to withdraw from an off-premises or distance contract where the Consumer has requested that the provision of the service commence before the expiry of the 14-day withdrawal period (participation in a class). If the Consumer withdraws from the contract, the Consumer may be required to pay for services provided up to the time of withdrawal, to the extent and in accordance with the rules set out in the applicable provisions of law.
- The Consumer shall not have the right to withdraw from an off-premises or distance contract relating to participation in a group class on a specific date and at a specific time.
- Matters concerning withdrawal from the contract, refunds and settlement for services which have already commenced shall be governed by the provisions of the Civil Code, the Act of 30 May 2014 on Consumer Rights and other applicable provisions of law.
- The Consumer may send a notice of withdrawal electronically to kontakt@studiosante.pl or reklamacje@studiosante.pl, submit it directly at the Studio Sante reception desk at the Organiser’s registered office, or send it by registered post. The notice may be submitted in any form that clearly expresses the intention to withdraw from the contract and identifies the person withdrawing from the contract and the contract concerned.
§ 8. Personal data protection
- The controller of the personal data of Participants in the classes is Sante sp. z o.o., with its registered office in Warsaw at ul. Jagiellońska 55A, 03-301 Warsaw, Tax Identification Number (NIP): 524-10-06-610, National Business Registry Number (REGON): 010827252.
- In matters relating to the processing of personal data, the Controller or the Data Protection Officer may be contacted by email at iod@sante.pl or in writing at the address of the Controller’s registered office.
- Detailed information concerning the rules governing the processing of personal data, the rights available to Participants and the manner in which those rights may be exercised is provided in the Studio Sante Privacy Policy available at studiosante.pl/en/privacy-policy/.
§ 9. Final provisions
- Any matters not governed by these Terms and Conditions shall be subject to the generally applicable provisions of law, in particular the provisions of the Civil Code and the Act of 30 May 2014 on Consumer Rights.
